Article 4 (Effect and Amendment of the Terms)
(1) These Terms take effect when they are posted on the Service screen or otherwise notified to Members.
(2) The Company may amend these Terms to the extent that doing so does not violate applicable laws such as the Act on the Regulation of Terms and Conditions and the Act on the Consumer Protection in Electronic Commerce, Etc. (the "E-Commerce Act").
(3) When amending these Terms, the Company will announce the amendment on the Service screen beginning 7 days before the effective date, specifying the effective date and the reasons for the amendment. However, for an amendment unfavorable to Members, the Company will make the announcement beginning 30 days before the effective date and will notify each Member individually by electronic means such as email or in-service notifications.
(4) Where the Company, in making the announcement or giving the notice under paragraph (3), has clearly informed Members that a Member who does not indicate an intention to refuse by the effective date will be deemed to have consented to the amended Terms, and a Member nonetheless does not expressly indicate an intention to refuse, the Member is deemed to have consented to the amended Terms.
(5) A Member who does not consent to the amended Terms may terminate the service agreement. Where a Member refuses the application of the amended Terms, the Company may terminate the service agreement only where there are special circumstances under which the previous Terms cannot be applied, and in that case fees for Paid Services are handled as provided by applicable laws.

Where individual terms of use to which a Member has agreed differ from these Terms, the individual terms of use prevail, and Article 4 applies mutatis mutandis to amendments of individual terms of use.
(3) These Terms are based on the Korean version, and any version provided in another language is a translation for reference. If the Korean version and a translation differ, the Korean version prevails.
Chapter 2 Service Agreement
Article 6 (Formation of the Service Agreement)
(1) The service agreement is formed when a person wishing to use the Service agrees to these Terms and applies for membership in accordance with the procedure set by the Company, and the Company accepts the application.
(2) Only persons who are 19 years of age or older may sign up for the Service.
(3) Each person may hold only one Account.
Article 7 (Acceptance and Restriction of Applications)
(1) The Company may decline to accept an application that falls under any of the following, or may terminate the service agreement even after acceptance.
- where the application is made using another person's name, account or email address
- where false information is provided or information required by the Company is not provided
- where the application is made by a person under 19 years of age
- where the applicant has previously lost eligibility to use the Service under these Terms
- where the applicant intends to use the Service for an improper purpose
- where the application is otherwise made for a purpose that violates applicable laws or does not meet the sign-up requirements set out in these Terms
(2) The Company may defer acceptance where its facilities lack capacity or where there are technical or operational problems.
Article 8 (Account Management)
(1) Members are responsible for managing their Account and their sign-in methods, such as passwords, and may not transfer or lend their Account to, or share it with, any third party. Members may not transfer or gift their status under the service agreement or their right to use the Service to any third party, or provide it to any third party as security.
(2) Where a Member logs in with a third-party account such as a Google or Apple account, the management of that account is governed by the terms and policies of that third party, and the Member must keep that account secure.
(3) If a Member becomes aware that the Member's Account has been misappropriated or is being used by a third party, the Member must notify the Company immediately and follow the Company's instructions.
(4) Where misappropriation or unauthorized use of an Account is suspected, the Company may, in order to protect the Member, temporarily restrict use of that Account or request necessary measures such as identity verification.
(5) The Company is not liable for damages arising from a Member's violation of paragraphs (1) through (3). However, this does not apply where the Company is at fault.
Article 9 (Termination of Membership)
(1) Members may request to terminate their membership at any time from the account page in the Service or by email (contact@swifin.app), and the Company will process the request as required by applicable law.
(2) Upon withdrawal, the Member's Input Information is deleted, except for information retained in accordance with applicable laws and the Privacy Policy, and deleted information cannot be recovered.
(3) Where a Member withdraws while using Paid Services, fees are handled in accordance with Article 18.
Chapter 3 Use of the Service
Article 10 (Provision of the Service)
(1) The Company provides Members with information such as portfolio analysis, market information and comparisons with past market conditions. The specific content of the Service is described on the Service screens.
(2) The Company does not receive, transmit or execute trade orders or hold money or securities in custody, and Members enter and register the information necessary for use of the Service themselves.
(3) As a rule, the Service is provided 24 hours a day, every day of the year. However, the Service may be changed or suspended in accordance with Article 14.
(4) To the extent necessary for the stable operation of the Service and the prevention of abuse, the Company may set the scope of use of the Service, such as the number of uses and the volume of use, and describe it on the Service screens. The scope of use of Paid Services is as described on the payment screen or other screens, and any change to it is subject to Article 14(1).
Article 11 (An Information Service, Not Investment Advice)
(1) The Content provided by the Service is information produced by the Company by analyzing or organizing Members' Input Information and market data according to criteria set by the Company, and does not constitute advice on the value of financial investment products or on investment decisions, investment solicitation or investment advisory services.
(2) The Company does not engage in investment consultation, investment solicitation or discretionary investment management, and does not guarantee returns or compensate for losses. Even where particular financial investment products, comparison results or cases similar to past market conditions are displayed in the Service, they are merely results produced according to criteria set by the Company and do not solicit or recommend the purchase, sale or holding of those financial investment products.
(3) Decisions on whether to invest and on the investment target, timing, quantity, price and the like are made at the Member's own judgment and responsibility, and any resulting gains and losses accrue to the Member. Investing in financial investment products carries a risk of loss of principal.
(4) The Company does not provide tax, legal or accounting advice. Amounts and returns displayed in the Service may not reflect taxes, fees and the like.
Article 12 (Limitations of Information)
(1) Historical records displayed in the Service and figures recalculated using historical prices are not returns from actual trading, and past results do not guarantee future results.
(2) The Content is produced according to criteria and methods set by the Company, and results may differ if the criteria, periods or the like differ.
(3) Market data is obtained from external information providers and other sources, and may be delayed, omitted or corrected after the fact.
(4) The Content depends on Members' Input Information and may differ from the balances or profits and losses provided by financial institutions.
(5) The Company does not warrant the accuracy, completeness or timeliness of the Content or its fitness for any particular purpose of a Member. Where the Company determines that the Content contains errors or needs to be updated, the Company may modify, correct or delete the Content without prior notice.
(6) The Company does not warrant that it will identify, through the Service, every event or price movement that occurs in the market, or that it will notify Members of them by any particular time.
(7) Paragraphs (5) and (6) do not limit the Company's liability in cases falling under Article 27(3).
Article 13 (Use of Generative Artificial Intelligence)
(1) Pursuant to Article 31(1) of the Framework Act on the Development of Artificial Intelligence and the Establishment of a Foundation for Trust (the "AI Framework Act"), the Company hereby gives notice that some features of the Service are provided using generative artificial intelligence.
(2) Outputs of generative artificial intelligence may be inaccurate or incomplete, and do not constitute advice on the value of financial investment products or on investment decisions, investment solicitation or investment advisory services. The Company does not warrant the accuracy or completeness of outputs, and Members must not make investment decisions relying solely on outputs.
(3) The Company indicates that outputs are the product of generative artificial intelligence as provided by applicable laws, including Article 31(2) of the AI Framework Act.
(4) Members must not enter into generative artificial intelligence features any sensitive information, unique identification information, personal information of others, or content that infringes the rights of others.
(5) The Company may restrict the provision of outputs in response to inputs seeking investment decisions, such as whether to buy or sell a particular financial investment product, and in response to inputs that violate applicable laws or these Terms, and may modify or delete outputs that it determines to be inaccurate or inappropriate.
Article 14 (Changes to and Suspension of the Service)
(1) The Company may change all or part of the Service where there are substantial operational or technical reasons. Where the content of the Service is changed materially to the detriment of Members, the Company will announce the change on the Service screen before the change is made, and where key content of Paid Services is changed to the detriment of Members, the Company will notify each Member using those Paid Services individually.
(2) The Company may temporarily suspend all or part of the Service in any of the following cases.
- where facilities are being repaired, inspected or replaced, or have failed
- where there is a communications failure, or the service of an external provider used by the Company is suspended
- where the provision of market data is suspended or delayed
- where there is force majeure, such as a natural disaster or national emergency
- where urgent security measures are necessary
(3) When suspending the Service under paragraph (2), the Company will give advance notice. However, where there are unavoidable reasons that prevent advance notice, the Company may give notice afterward.
(4) The Company may change or terminate all or part of the Service provided free of charge as required for its business and, in the case of termination, will announce it on the Service screen at least 30 days before the termination date. Unless applicable laws specifically provide otherwise, the Company does not provide separate compensation for the change or termination of the Service provided free of charge.
(5) The Company may terminate all or part of the Service, including Paid Services, where there are substantial reasons such as the discontinuation of its business or a change in its business plans. In that case, the Company will announce the termination on the Service screen at least 30 days before the termination date and notify each Member using Paid Services individually, and will refund fees for the period that could not be used as provided by applicable laws.
(6) Where the content of Paid Services has been changed materially to the detriment of Members, a Member may terminate the service agreement, and in that case fees are handled as provided by applicable laws.
Article 15 (Notices to Members)
(1) The Company may give notices to Members by email, in-service notifications, posting on the Service screen and other methods.
(2) For notices to all Members, the Company may post the notice on the Service screen for at least 7 days in lieu of individual notices. However, matters that materially affect Members will be notified individually.
(3) Members must maintain an email address at which they can receive notices from the Company, and the Company is not liable for any disadvantage arising from a Member's failure to receive notices because the Member registered an incorrect email address or did not update a change. However, this does not apply where the Company is at fault.
Chapter 4 Paid Services
Article 16 (Paid Services)
The Company may provide Paid Services, and the content, fees, payment methods, Billing Periods and other details of Paid Services are posted on the payment screen or other screens.
Article 17 (Recurring Billing and Fee Changes)
(1) Paid Services are provided on a recurring billing basis and, unless the Member cancels, are renewed by automatic payment on the same terms at the end of each Billing Period.
(2) If the Company increases the fee for recurring billing, or converts a Member to paid recurring billing after a free period ends, the Company will give advance notice and obtain the Member's consent as provided by applicable laws. If the Member does not consent, the recurring billing ends at the end of the relevant Billing Period or, as the case may be, is not converted to paid recurring billing.
Article 18 (Cancellation and Refunds)
(1) Members may cancel recurring billing at any time, and upon cancellation no fees are charged from the next payment date. Even after cancellation, Members may use Paid Services until the end of the Billing Period already paid for.
(2) Fees for a Billing Period already paid for are not refunded on a pro rata daily basis for the unused period, even upon cancellation or termination of membership. However, in the case of a withdrawal of an offer under Article 19, where the Member was unable to use Paid Services for reasons attributable to the Company, or in any other case provided by applicable laws, the applicable provisions govern.
(3) Where a Member applies to terminate their membership during a Billing Period, the Company will inform the Member, before the termination, that the Member may terminate after using Paid Services until the last day of the remaining Billing Period, and of how fees are handled in the case of immediate termination. If the Member chooses immediate termination after receiving this information, fees for the remaining Billing Period are handled in accordance with paragraph (2).
(4) If a fee is charged in error, the Company will refund it in accordance with applicable laws.
Article 19 (Withdrawal of Offer)
(1) Members may withdraw their offer within the period provided in Article 17(1) of the E-Commerce Act (7 days from the date on which the Member receives the written document setting out the contract terms or, where the provision of Paid Services begins later than the receipt of that document, 7 days from the date on which provision begins). However, where the provision of Paid Services has commenced, withdrawal of the offer may be restricted under Article 17(2)(v) of the E-Commerce Act.
(2) The Company will clearly indicate, in a place where Members can easily see it, such as the payment screen, the fact that withdrawal of the offer is restricted under the proviso to paragraph (1), and will take measures such as providing a trial-use product as provided by applicable laws.
(3) Refunds upon withdrawal of an offer are made within the periods and by the methods provided by applicable laws.

- accessing the Service or collecting the Content through any route other than the screens or methods provided by the Company
- any other conduct that violates applicable laws or is contrary to good morals or other social order
(2) Persons who are not Members may access the Service and view the Content only to the extent permitted by the Company, and the Company does not permit access for the purpose of the conduct described in paragraph (1)(iii) through (vii) and (xiii). The Company may block such access and take measures under applicable laws.
Article 23 (Restrictions on Use)
(1) If a Member violates these Terms or interferes with the normal operation of the Service, the Company may restrict the Member's use of the Service by means such as a warning, suspension of use or termination of the service agreement.

However, where there are unavoidable reasons that prevent advance notice, the Company may give notice afterward, and the Company may withhold matters whose disclosure could impair the security or operation of the Service, such as the methods used to identify abuse. The Member may file an objection, and if the Company finds the objection justified, it will resume the Member's use of the Service without delay.
(4) Where the service agreement is terminated for reasons attributable to the Member, fees for Paid Services are handled as provided by applicable laws.
Article 24 (Input Information)
(1) Rights to and responsibility for Input Information belong to the Member.
(2) The Member permits the Company (including any person to whom the Company has entrusted work) to store, reproduce, process and use Input Information to the extent necessary to provide, operate and improve the Service.
(3) The Company may use statistical information created by processing Input Information so that individuals cannot be identified for compiling statistics, research, improving the Service and developing new services, and this also applies after the service agreement ends.

Article 25 (Intellectual Property)
(1) All rights to the Service, the Content and the databases that constitute them, including copyrights, database producers' rights and trademark rights, belong to the Company or the legitimate rights holders. However, Input Information is excluded.
(2) The service agreement grants Members only the right to use the Service within the scope set out in these Terms, and is not to be construed as transferring the Company's rights or permitting any use not set out in these Terms.
(3) Members may use the Service only for their own personal, non-commercial purposes and, except where they have entered into a separate agreement with the Company, may not, without the Company's prior written consent, use the Content by means such as reproduction, distribution, transmission or the creation of derivative works, or allow third parties to do so. This applies regardless of whether the Content is protected under the Copyright Act. However, this does not apply to the extent permitted under Articles 28 and 30 of the Copyright Act.
